Abstract

Over the past 10 years, the number of court cases against dentists and the quality of dental care has increased dramatically. An analysis of the entire judicial practice for 2013-2024 in Russia allowed us to identify the main trigger points that lead to patients going to court. There are specific features in each region of Russia, but there are clearly general trends. The main risks and treatment methods that most often lead to unsatisfactory treatment results and conflicts between patients and dentists have been identified. The economic, legal and social consequences of court cases for clinics have been determined. The study has convincingly proved that up to 30% of court conflicts are caused by improper organization of dental care and could be resolved at the pre-trial level. An analysis of judicial practice, conclusions of forensic medical examinations, court decisions and the reasons for patients' appeals to the court allowed us to identify areas for corrective measures in the organization of dental clinics. Our research and practical work shows, that it is possible to significantly reduce the risks of legal conflicts and significantly reduce payments imposed by the courts by changing approaches to the organization of dental care. In addition, it is important to focus on the formation of a package of basic documents accompanying treatment and changing the mentality of dentists, improving their legal literacy.
